Terms of Use

Effective date: July 14, 2026  ·  Last updated: August 13, 2026

These Terms of Use are a binding agreement between you and Talon Trader Funding LLC. By creating an account, purchasing a program, or using our services, you agree to them.

1. Who we are

Talon Trader Funding LLC ("Talon", "we", "us") is a Wyoming limited liability company operating the TalonProp and Talon Trader Funding brands. We provide simulated futures trading evaluation programs and related software. We are not a broker-dealer, futures commission merchant, investment adviser, or money transmitter, and we do not hold, custody, or transmit customer funds.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher), legally able to enter a contract, and resident in a territory Talon serves. Talon serves traders worldwide except in the restricted territories listed in our Eligibility & Restricted Jurisdictions policy, which is the authoritative statement of where we operate and which forms part of these Terms. You must not be subject to any sanction or restriction described in that policy. One person may hold only one profile. Registering more than one profile, or registering on behalf of another person, is prohibited.

3. What you are purchasing

You are purchasing access to a simulated evaluation program (T-Flight) and, on successful completion and activation, access to a simulated-funded account (Crest) under which you may become eligible for performance-based rewards. You are not purchasing capital, a funded brokerage account, securities, futures contracts, employment, or any guarantee of a reward. All accounts are simulated at every stage.

4. Program rules

Each account is governed by the program rules published in our knowledge base and by the Prohibited Activities, Payouts (Rewards), and Refund & Billing policies, all of which are incorporated into these Terms by reference. The rules that apply to any account are the rules in effect at the time that account was purchased, as recorded by us at purchase. Rules may change for future purchases. You are responsible for reading the rules applicable to your account before you purchase.

5. Fees, payment, and renewal

Prices are shown at checkout in U.S. dollars and are payable in full at the time of purchase, except where an activation fee is expressly deferred. Evaluation purchases are one-time charges and do not automatically renew. Software subscriptions, where offered, are recurring until cancelled, and you may cancel at any time effective at the end of the then-current billing period. We may change prices at any time; changes do not affect an account already purchased. A T-Flight evaluation account is open for 28 calendar days from the day it is provisioned, or until it passes or fails, whichever comes first; it does not renew and cannot be extended. Refunds are governed by the Refund & Billing Policy.

6. Your account and security

You are responsible for your login credentials and for all activity under your profile and trading accounts. Do not share, sell, transfer, rent, or otherwise give access to your accounts. Accounts are personal and non-transferable. Notify us immediately at support@talontraderfunding.com if you believe your credentials have been compromised.

7. Acceptable use and prohibited conduct

You agree to comply with the Prohibited Activities policy in full. That policy sets out the conduct that is not permitted in Talon programs and the consequences of breaching it, which include failure of all of your accounts, forfeiture of all accumulated simulated gains, and cancellation of pending reward requests, including requests already approved but not yet paid.

8. Enforcement and review

We monitor accounts for rule compliance. Automated systems may flag activity for review; they do not make final determinations. Decisions that end an account, forfeit gains, or cancel a reward are made by Talon personnel after review of the account record, and that review is documented. Where we determine that a breach has occurred, our determination is final.

9. Software licence

Where we make software available to you — including trader dashboards and any bundled tools — we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use it for your own accounts, for as long as your account is in good standing. You may not copy, resell, reverse-engineer, sublicense, or use it to provide a service to any third party.

10. Intellectual property

All content, branding, program design, rules, software, and materials made available by Talon are owned by Talon or its licensors and are protected by law. Nothing in these Terms transfers ownership to you. You may not reproduce or distribute our materials without our prior written permission.

11. Third-party platforms and data

Our programs depend on third-party trading platforms, market-data providers, and connectivity services. Your use of those platforms may be subject to their own terms. We are not responsible for the acts, omissions, outages, errors, or data of third parties, and we do not guarantee uninterrupted or error-free service.

12. Risk acknowledgement

You confirm that you have read the Risk Disclosure Statement, that you understand all Talon trading is simulated, that most participants do not pass an evaluation, that no income or outcome is promised, and that the fee you pay is at risk.

13. Suspension and termination

You may stop using our services at any time. We may suspend or terminate your access, any account, or your profile, with or without notice, if we determine that you have breached these Terms or any incorporated policy, if required by law or by a third-party provider, or if we discontinue a program. Where termination follows a breach, the consequences in the Prohibited Activities policy apply. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

14. Disclaimer of warranties

Our services are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation, to the fullest extent permitted by law.

15. Limitation of liability

To the fullest extent permitted by law, Talon and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost opportunity, lost simulated gains, or loss of data, arising out of or relating to your use of our services, whether based in contract, tort, or any other theory, even if advised of the possibility. Our total aggregate liability for any claim relating to our services will not exceed the amount you paid to Talon in the six months immediately preceding the event giving rise to the claim.

16. Indemnity

You agree to indemnify and hold harmless Talon and its members, officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms or any incorporated policy, your misuse of our services, or your violation of any law or third-party right.

17. Communications

We communicate by email. You consent to receive account, transactional, and program communications electronically, and you agree that electronic records and signatures satisfy any legal requirement for a writing. You may opt out of marketing emails at any time; transactional emails are required for as long as you hold an account.

18. Changes to these Terms

We may update these Terms. The current version is always posted here with its effective date. Changes apply to purchases made after the effective date; the rules applicable to an account already purchased are those recorded at the time of that purchase. Continued use of our services after an update means you accept the updated Terms.

19. Governing law and venue

These Terms and any dispute arising from them are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. You and Talon agree that the exclusive venue for any dispute is the state or federal courts located in Sheridan County, Wyoming, and each party consents to the personal jurisdiction of those courts.

20. General

These Terms, together with the policies incorporated by reference, are the entire agreement between you and Talon regarding our services. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
